1.Consumer Rights and Guarantees:
This module dives into the core protections offered by the Australian Consumer Law (ACL) to consumers. It explains automatic guarantees that apply to most goods and services purchased in Australia. These guarantees ensure you receive a fair deal and have recourse if something goes wrong. Key areas covered include:
  • Guarantee of Acceptable Quality: Products must be in good condition, safe to use, and durable for a reasonable period.
  • Guarantee of Fitness for Purpose: Goods must be fit for the specific purpose you discussed with the seller.
  • Guarantee of Matching Descriptions: Products must match any descriptions, samples, or models shown before purchase.
  • Express Warranties: If a warranty is offered, the business must honor it if the product fails within the terms.
2.Anti-competitive Behaviour:
This module explores anti-competitive behaviour, practices that businesses may use to gain an unfair advantage and limit consumer choice. The ACL prohibits such practices to ensure a fair and healthy marketplace. Here's what you'll learn:
  • Cartel Conduct: Agreements between competitors to fix prices, limit production, or divide markets. This harms consumers by raising prices and reducing options.
  • Misuse of Market Power: Dominant businesses using their position to unfairly exclude competitors or squeeze suppliers.
  • Mergers and Acquisitions: When mergers or acquisitions substantially lessen competition, they may be restricted by the ACL.
3.False Advertising:
This module focuses on the Australian Consumer Law's (ACL) regulations regarding false and misleading advertising. Deceptive advertising can lure consumers into making choices they might regret. Here's what you'll discover:
  • Misleading Representations: Creating false impressions about a product or service through advertising claims, visuals, or omissions of key information.
  • Bait and Switch: Luring customers with a low advertised price for a product with no intention of supplying it, then pressuring them to buy a more expensive option.
  • Deceptive Pricing: Hiding the true cost of a product or service through misleading price tags, fine print, or hidden fees.
4.Pricing and Surcharging:
This module tackles the regulations around pricing and surcharging outlined in the Australian Consumer Law (ACL). It empowers you to be a savvy consumer and understand the breakdown of costs you encounter when purchasing goods and services. Here's what you'll learn:
  • Clear and Transparent Pricing: Businesses must display clear and inclusive prices for goods and services, including all taxes and compulsory charges.
  • Surcharging for Payments: Businesses can charge surcharges for specific payment methods (e.g., credit cards) but only if the fee reflects the cost they incur for processing that payment.
  • Minimum Purchase Amounts for Card Payments: Businesses can set a minimum purchase amount for using card payments, but the threshold must be reasonable.
